Contract terms and remuneration structures
Starting a new role can be exciting, but it can also carry risk. We review your new contract (and any restrictions in your current one) so you understand your pay, protections, and any clauses that could limit your next move.
When accepting a new role, there is a lot to consider and evaluate, especially as moving roles carries risk around job security and could see the loss of certain benefits and bonuses/awards.
The starting point when deciding whether to accept a new role will be to understand the key contractual terms that will govern your employment. These will likely cover those associated with notice, any acceptance/signing-on bonus, restrictive covenants, shares/equity and annual reward.
We can review your terms and advise on ways to enhance your protection.
We pay particular attention to any post termination restrictive covenants, as these will impact your ability for future employment when your new role ends. In parallel, we can also review any restrictions you are bound by in your current role to explain the risk of any action against you by accepting the new position.
We regularly see post termination restrictive covenants being enforced and seeking changes to these when you start a new role is the best time, as it is when you are likely to have the greatest negotiating position. Once you accept the contractual terms these will apply even if you are unfairly dismissed.
When it comes to your remuneration, we can explain what you will be paid, and when, and the likelihood of you earning what you may have been promised. Your service agreement/contract of employment will override any prior promises that may have been made during recruitment, or even in the offer letter, so it is important to know what might impact your earnings.
We will also look and other terms, like notice periods and any sign-on bonuses, and, if appropriate, ensure other protections are in place or raised, so you accept the terms in the full knowledge of what your duties and rights are.
