Grievances

Grievances

These are complaints by your staff about something related to the workplace. You should have a grievance procedure that you follow, which should provide that you investigate the complaint, meet with the employee and reach a conclusion.

Often the topics raised are of a serious nature. They could accuse the business, or a senior individual within it, of discrimination, bullying or some form of detrimental treatment. The issues involved may require a degree of sensitivity.  Any findings in the employee's favour may lead to further actions, such as disciplinary procedures if another employee has behaved inappropriately.

When dealing with grievances you need to follow your own procedures and comply with the ACAS code of practice. Failure to follow the ACAS code can see any compensation awarded to the employee increased by up to 25%.

When concluding grievances you need to know that any finding in support of the employee could give him/her a green light to pursue a tribunal claim, so balancing the facts while protecting your business is key and our expert employment solicitors will be able to guide and support you through any grievance procedure no matter how sensitive or difficult.
