If you need to downsize or restructure, there are certain factors to take into account.

The starting point is to work out whether the collective redundancy rules apply, as these impose additional obligations on you when embarking on a redundancy process. At a basic level, if you are proposing to dismiss more than 20 employees in a 90-day period, the collective rules will apply. The test is more involved than this, so specialist employment law advice should be sought.

If you are not bound by the collective rules, we encourage you to take advice as early as possible and certainly before you begin discussing individual employees.
